Clendons North Shore presented a discussion paper on New Zealand's response to the global financial crisis, including evolution of law and policy changes that will encourage overseas businesses seeking to operate here, in response to an invitation by Mackrell International to submit research and presentation papers for the 2009 Americas and Asia-Pacific Regional Meeting held on October 23-25th 2009 in Philadelphia, Pennsylvania, United States. A symposium was held on Friday, October 23, 2009 and bought together clients, friends and members of the Philadelphia-area business and legal community along with the Member Firms and Delegates to discuss cutting edge issues relating to law, innovation and economic growth opportunities between the Americas and the Asia-Pacific region.

Hosting other people’s data imposes a raft of responsibilities. As customers become ever more demanding when it comes to entrusting their personal or mission-critical data to another firm, it is essential for service providers to understand and manage their risks. Recent, widely reported failures overseas have raised public and corporate scrutiny towards those hosting their data. The Government has recently enacted new laws imposing, for the first time, specific obligations on firms that host data. This seminar covers key topics that everyone who hosts other people's data need to be aware of.

- The Faustian Bargain: Digital Rights Management software updates and other Microsoft licensing issues

This presentation was given to New Zealand Computer Society members at their Wellington branch.
Digital Rights Management (DRM) is currently a very controversial subject.
DRM is, of course, much bigger than just music and a technological hurdle for mp3 rippers. DRM will be used with documents, spreadsheets, presentations, databases, programmes, photos and movies. The attraction of using DRM controls for these everyday files is to provide a technological barrier to breaches of commercial confidentiality, to beef up privacy and to protect against other types of intellectual property infringement.
Although DRM is widely supported in the software development industry, there are aspects of the broader DRM concept that raise significant concerns for the judicial system in terms of production of electronic evidence in Court.
Craig discussed the DRM issues and licensing issues outlining the changes to software assurance which were announced by Microsoft and the legal issues relating to unilateral changes.

This IIR conference addressed the legal issues surrounding the internet, including the Electronic Transactions Bill, managing corporate risks, securing online transactions and examining the future of Internet Law.
Emily and Tony specifically presented on managing corporate risk, which will be illustrated through two case studies:
examining the provision of ASP services by analysing the relationship that exist in the distribution chain where those relationships may span multiple jurisdictions
taking a practical approach to managing risks in a local web-based application.
The focus in these case studies is on being effective in your approach to managing risks, by providing framework for identifying and mitigating appreciable risks and actions to take when a risk is realised.
